Massachusetts Custody Law for Mothers: What You Need to Know

Understanding how Massachusetts courts make custody decisions gives you a clearer picture of what to expect and why early preparation matters.

The Best Interests of the Child Standard

All custody decisions in Massachusetts are governed by the best interests of the child standard. For married parents, the controlling statute is G.L. c. 208, s. 31. For unmarried parents, it is G.L. c. 209C, s. 10. Massachusetts defines four custody categories: sole legal custody, shared legal custody, sole physical custody, and shared physical custody. A court can order any combination of these based on the family’s circumstances.

Unlike many states, Massachusetts doesn’t provide a statutory checklist of best-interest factors for final custody orders. Judges exercise broad discretion, examining each parent’s relationship with the child, the stability of each household, the child’s adjustment to home and school, each parent’s willingness to support the other’s involvement, and any history of domestic violence or abuse. Under G.L. c. 208, s. 31A and G.L. c. 209C, s. 10, a finding that a pattern or serious incident of abuse has occurred creates a rebuttable presumption against awarding that parent sole, shared legal, or shared physical custody. There is no presumption favoring either parent based on gender at the final order stage.

Married vs. Unmarried Mothers

A mother’s legal position at the start of a custody case depends on marital status. For married parents, upon filing a divorce action, both parents receive temporary shared legal custody by default under G.L. c. 208, s. 31, absent a finding of abuse or neglect. There is no corresponding presumption of temporary shared physical custody.

For unmarried mothers, the starting position is stronger. Under G.L. c. 209C, s. 10(b), the person who gave birth holds sole legal and physical custody of a nonmarital child prior to any adjudication or voluntary acknowledgment of parentage. That custody continues even after a voluntary acknowledgment is signed. The unmarried mother retains custody unless and until another parent obtains shared or sole custody through a court order. The Massachusetts Parentage Act, effective January 2025 (St. 2024, c. 166), updated parentage law for the first time in 40 years, replacing “paternity” with “parentage” and expanding the pathways available to establish legal parent status.

Relocation & Removal from Massachusetts

A mother who holds physical custody and wants to relocate permanently with her child outside Massachusetts must obtain either written consent from the other parent or a court order under G.L. c. 208, s. 30. The governing standard is the best interests of the child, not a presumption for or against relocation. The leading case, Yannas v. Frondistou-Yannas, 395 Mass. 704 (1985), requires the court to evaluate whether there is a genuine reason for the move and whether relocation may benefit the child, weighed against the impact on the child’s relationship with the non-relocating parent.

The standard is more demanding when shared physical custody is in place. Under Mason v. Coleman, 447 Mass. 177 (2006), a parent in a shared physical custody arrangement faces a higher bar to obtain removal than a parent with sole physical custody. An unmarried mother whose child’s parentage hasn’t been legally established may be able to relocate without court involvement, since the other party has no legal rights requiring court protection until parentage is adjudicated under G.L. c. 209C.

Modifying Orders & Enforcing Compliance

Custody and parenting time orders can be modified when there has been a material change in circumstances since the order was entered. Massachusetts courts are reluctant to disturb established parenting arrangements without a clear demonstration of that change, which is one reason the arrangement entered early in a case carries lasting weight.

When a co-parent violates a custody or support order, contempt proceedings in Worcester Probate and Family Court can compel compliance. Enforcement tools for child support non-payment may include wage garnishment, property liens, passport denial, credit bureau reporting, and contempt findings that can result in incarceration. Child support obligations are calculated under Massachusetts guidelines, and both parents carry a legal obligation to financially support their child regardless of marital status.
